Dream Studio Terms of Service

1. Operator and scope

Dream Studio is a digital image-generation service operated by Entreprise Individuelle – MIMOUNI Mehdi, 530 route de Salignac, 33240 Saint-André-de-Cubzac, France, registered with RCS Libourne 838 940 328. Contact: [email protected].

These Terms of Service govern access to the Dream Studio website, purchase of generation credits, use of the AI-assisted portrait workflow, and download of generated HD files.

2. Description of the service

Dream Studio allows users to upload a source portrait, choose a pose and generation options, obtain AI-generated previews, and download one HD output when available under the purchased credit pack.

The service is a digital service only. No physical goods are shipped. Delivery is performed digitally after payment or after use of available credits.

3. Eligibility and user certifications

You must be at least 18 years old and legally capable of entering into binding contracts to use Dream Studio.

By generating, ordering, uploading, or downloading through Dream Studio, you certify that the uploaded portrait is your own image or that you hold all rights, permissions, and consents required to upload it, process it through Dream Studio and its subprocessors, and generate derivative outputs from it.

You also certify that the uploaded image does not depict a minor, a celebrity, or any third party whose likeness you are not authorized to use.

4. Prohibited uses

You may not use Dream Studio for unlawful, deceptive, harmful, or abusive purposes. Prohibited uses include, without limitation: portraits of minors, sexualized or exploitative content involving minors, unauthorized use of a celebrity likeness, non-consensual intimate content, identity impersonation, deceptive advertising, hateful or violent content, fraud, or infringement of third-party rights.

Dream Studio may reject, suspend, cancel, or block any session or order that appears to breach these Terms, payment-provider rules, platform policies, or applicable law.

5. Adult-only moderation and automated checks

Dream Studio may run automated adult-only checks on uploaded source portraits before the portrait can be used and again before generation is processed. If the image appears to depict a minor, multiple people, no clear face, or an ambiguous youthful-looking face, the portrait may be rejected.

Automated moderation reduces risk but is not infallible. You remain solely responsible for the legality of the content you upload and use.

6. Pricing, payment, and delivery

Prices shown on the site may be displayed in a local currency estimate, while settlement may occur in another supported currency through a third-party payment provider. The applicable price is the amount confirmed at checkout.

Full payment is required before paid credits or paid delivery are made available. Generation may start automatically after payment confirmation. The service is performed digitally and without shipment of physical goods.

By proceeding with payment and using the service immediately, you expressly request immediate performance of the digital service. To the extent permitted by applicable law, once generation has started or the HD file has been made available, you acknowledge that your right of withdrawal may no longer apply.

7. Refunds and technical incidents

If a paid generation cannot be delivered because of a confirmed technical failure attributable to Dream Studio, duplicate payment, or another verified payment-processing issue, you may contact [email protected] for review.

Dream Studio may refuse refunds where the service was correctly delivered, where the uploaded content breached these Terms, or where the issue results from user-provided material, unsupported expectations, or prohibited use.

8. Intellectual property and output license

You retain your rights in source material you lawfully upload. You grant Dream Studio and its technical providers a limited non-exclusive license to host, process, transform, store temporarily, and transmit that material solely for operating the service, moderation, fraud prevention, troubleshooting, and delivery.

Subject to your compliance with these Terms and any third-party rights, Dream Studio grants you a non-exclusive license to use the generated outputs delivered to you. This license does not validate unlawful source material or override third-party rights.

9. Availability and limitation of liability

Dream Studio is provided on an 'as available' basis. AI-generated outputs may contain inaccuracies, artifacts, or unexpected results. Dream Studio does not guarantee uninterrupted availability, specific aesthetic outcomes, or suitability for every commercial use.

To the fullest extent permitted by law, Dream Studio is not liable for indirect, incidental, or consequential losses, loss of profits, advertising rejection, or claims arising from unauthorized source content uploaded by the user.

10. Suspension, termination, and evidence

Dream Studio may refuse service, suspend access, cancel unpaid or suspicious transactions, or keep internal compliance logs where required to document moderation, payment verification, fraud prevention, abuse prevention, and legal defense.

Where appropriate, Dream Studio may preserve limited evidence of moderation decisions, transaction metadata, and compliance confirmations to defend legal claims or satisfy legitimate legal obligations.

11. Governing law and disputes

These Terms are governed by French law. Mandatory consumer-protection rules remain applicable where they cannot lawfully be excluded.

In the absence of an amicable resolution, disputes shall be submitted to the competent courts under applicable French procedural rules.
